Keith, Miller, Butler, Schneider & Pawlik, PLLC has a long history representing local, regional, and national banks and other financial institutions in all aspects of their relationships with borrowers, depositors, directors and employees. Our banking attorneys regularly advise banks, bank holding companies, and other financial institutions on a wide range of matters in the complex regulatory environment in which they operate. We serve as outside, general, and special counsel to financial institutions of all sizes.
Our lawyers are respected and experienced in the negotiating and drafting all forms of loan documents and security instruments and in assisting lenders with due diligence reviews of potential loan transactions as well as existing credit agreements. In addition to negotiating and documenting customized loan agreements for lending clients, our lawyers review existing client loan documents to ensure compliance with Arkansas law. We are frequently called upon to provide opinions to financial institutions regarding usury, lien priority questions, and the enforceability of security interests pursuant to Arkansas law.
We have also successfully represented lenders in litigation involving, among other issues, complicated commercial and residential foreclosure actions in Arkansas, lien priority disputes and representing financial institutions in connection with business restructuring and insolvency matters, including business reorganizations, debt workouts, bankruptcy litigation, and the enforcement of creditors’ rights and remedies. And we have successfully defended a number of financial institutions in claims arising from the lending relationship, including lender liability claims.
